Terms & Conditions

  • USE OF VEHICLE – Vehicles may only be driven within a 150 kilometer radius of central Cape Town unless otherwise specifically agreed. In the event of the Hirer driving the car outside this area without our prior consent he/she will be responsible for any costs incurred in repairing the vehicle and/or bringing it back to Cape Town in the event of an accident or breakdown. Where consent is given for the car to used outside the 150 kilometer area an additional charge of R100 per day will be payable. Vehicles may not be used on dirt roads. Our cars are fitted with tracking devices.
  • DEPOSIT – A deposit of R3,000 is required in respect of all rentals, irrespective of the duration. This may be paid by credit/debit card, electronic funds transfer or cash. A signed credit card imprint is required for all rentals. This imprint will be retained by us for a period of 60 days after the car has been returned and may be utilised to settle any traffic fines or other expenses incurred by the hirer which were not known or apparent when the car was returned. After 60 days the imprint will be destroyed provided that all amounts due have been settled in full at that time.
  • DRIVER – The hirer and any additional nominated drivers must produce a valid drivers license and his/her identity document or passport and be over the age of 18 years. There is no extra charge for additional drivers provided that we have been supplied with a copy of their drivers’ license and I.D prior to the rental commencing.
  • INSURANCE – The rate quoted includes comprehensive insurance cover, subject to an excess amount of R3,000. This excess may be waived for an additional cost of R30 per day. Unless this excess amount is waived the hirer will be responsible for any loss or damage to the vehicle, howsoever caused and irrespective of the culpability of the hirer up to an amount of R3,000. This includes broken windows/windscreens, damaged tires /hubcaps, stolen radios/cd players within the compulsory excess amount while the car is on hire to him/her. In the event of the hirer committing any act which invalidates our insurance policy the hirer hereby accepts full liability for all costs arising therefrom. Examples of such acts include driving under the influence of drugs or/alcohol, or permitting the vehicle to be driven by an unlicensed driver. Our insurance policy is available for inspection on request and includes 24/7 Roadside Assistance.

  • BREAKDOWN / ACCIDENTS – The rate quoted includes 24-hour road-side assistance. In the event of an accident or breakdown the hirer must call one of the numbers provided and our staff will arrange for assistance to be provided. In the event of the vehicle being out of service for any period as a result of a mechanical breakdown or accident the Company will supply an alternative vehicle if available. If no replacement vehicle is available, rental for the period that the original vehicle is unavailable will be waived but no claim will be entertained for the hiring of another vehicle.
  • FUEL POLICY – All vehicles are delivered with a full tank of petrol  and must be returned with a full tank. Alternatively we will refill the tank and debit the hirer. There is no additional charge for this service.
  • PAYMENT – All major credit cards, except for American Express and Diners Club, are accepted. All rentals are payable in advance.
  • RENTAL PERIOD – Should the rental period be extended or reduced the rate quoted will be adjusted in accordance with the rates applicable to the particular car for the new period. Any change to the original agreed rental period must be requested as soon as possible, and in any event at least 48 hours before the car was due to be returned. Failure to notify any such change may result in a penalty charge of R100 per day being levied, in addition to the applicable rental amount.
  • TRAFFIC FINES – The hirer will be responsible for all parking, speeding and other traffic fines incurred while the vehicle is on hire to him/her and authorizes Top Mark’s Car Hire to debit his/her credit card with the amount of any such fines received after the car has been returned to the company. There is no administration fee for this service.

 

  • DELIVERY/COLLECTION
     
    ·         Airport collection/drop off: R150 each way.
    ·         Cars may be collected either from Pinelands or Sea Point or can be delivered, free of charge, within a 20 kilometre radius of central Cape Town.
    ·         Delivery/collection beyond 20 kilometres of central Cape Town: R5 per km after the first 20 kms.
